Introduction

These Terms and Conditions govern your access to and use of the services provided by IndustrialHR Pty Ltd, operating across four service brands: IndustrialHR, IndustrialHR Alliance, IndustrialHR Talent, and IndustrialHR Payroll (collectively referred to as “we”, “us”, or “IndustrialHR”). By engaging our services, you agree to be bound by these terms. If you do not agree, you should not proceed with any engagement.

Use of Website

You must be at least 18 years of age to use our website or engage our services. You agree not to use our website or any materials accessible through it for any unlawful purpose or in any way that could damage, impair, or interfere with its operation.

Description of Services

We provide the following services across our four brands:
• IndustrialHR provides workplace relations advisory, case management, employment investigations, wage remediation, and Fair Work Commission representation.
• IndustrialHR Alliance provides ongoing HR and industrial relations advisory support through a monthly retainer, including access to templates, employment contracts, and policy documents.
• IndustrialHR Talent provides end-to-end recruitment services including candidate sourcing, screening, shortlisting, and placement.
• IndustrialHR Payroll provides payroll processing, system configuration, compliance support, and leave management services.
The scope of services for each engagement will be set out in a separate Engagement Agreement or Service Schedule. In the event of any inconsistency between these Terms and Conditions and an Engagement Agreement, the Engagement Agreement prevails.

Not Legal Advice

The services and information provided by IndustrialHR are not legal advice. While our work is grounded in legislation, awards, and industrial instruments, it is advisory in nature. IndustrialHR is not a law firm and does not engage in legal practice.

Fees and Payment

All fees are quoted in Australian dollars and are exclusive of GST. GST will be applied in addition to quoted fees where applicable. Fees are set out in the relevant Engagement Agreement or Service Schedule and are payable in accordance with the payment terms specified therein. We reserve the right to amend our fees. Where a fee change affects an existing ongoing arrangement, we will provide 60 days written notice before the change takes effect.

Cancellation

Written notice of at least 30 days is required to cancel any engagement or subscription. The following cancellation terms apply:
For project-based engagements under IndustrialHR (including case management, investigations, and wage remediation), a cancellation fee of 50% of the total project fee is payable upon cancellation, regardless of the stage at which cancellation occurs.


For IndustrialHR Alliance retainer arrangements, cancellation requires 30 days written notice. A cancellation fee equivalent to 50% of the remaining retainer fees payable under the current agreement period is applicable.
For IndustrialHR Talent recruitment engagements, a cancellation fee of 50% of the agreed placement or project fee is payable upon cancellation.


For IndustrialHR Payroll engagements, cancellation requires 30 days written notice. A cancellation fee equivalent to 50% of the remaining fees payable under the current agreement period is applicable.


Cancellation fees reflect costs already incurred and work already performed or committed to at the time of cancellation.

Refunds

No refunds are available for any services provided by IndustrialHR, IndustrialHR Alliance, IndustrialHR Talent, or IndustrialHR Payroll once an engagement has commenced or a subscription period has begun.

Intellectual Property

All documents, templates, frameworks, reports, and other materials produced or provided by IndustrialHR remain the intellectual property of IndustrialHR Pty Ltd unless expressly agreed otherwise in writing. You may use materials provided to you for the internal purposes for which they were prepared. You may not reproduce, distribute, or commercialise those materials without our prior written consent.

Confidentiality

We will treat all information provided to us in the course of an engagement as confidential and will not disclose it to third parties except where required to deliver the services, required by law, or with your consent. We ask that you treat any proprietary methodologies, templates, and systems of IndustrialHR as confidential.

Limitation of Liability

To the fullest extent permitted by law, our total liability to you arising out of or in connection with any engagement is limited to the fees paid to us in the six months preceding the event giving rise to the claim. We are not liable for any indirect, consequential, or economic loss. You agree to indemnify us against any claims arising from your breach of these terms or your misuse of advice or materials provided.

Privacy

Your personal information is handled in accordance with our Privacy Policy, available on our website. By engaging our services, you consent to the collection and use of your information as described in that policy.

Complaints

We are committed to delivering a high standard of service. If you have a complaint, please direct it in the first instance to [email protected]. We will acknowledge your complaint within two business days and respond substantively within ten business days.

General

These Terms and Conditions are governed by the laws of Queensland, Australia. Any dispute arising in connection with these terms will be subject to the exclusive jurisdiction of the courts of Queensland. If any provision of these terms is found to be unenforceable, the remaining provisions continue in full force. These terms constitute the entire agreement between us in respect of their subject matter and supersede any prior representations or arrangements. We reserve the right to update these terms and will communicate material changes as necessary.
